What are the H2A bond Requirements?
H2A Bond Requirements
for Farm Labor Contractors
Applying for an H-2A Farm Labor Contractor (FLC) bond involves more than just purchasing a policy. The U.S. Department of Labor requires specific compliance steps to ensure agricultural employers meet wage, housing, and worker protection standards under the H-2A program. Below is a clear breakdown of what is required and how the process works from start to finish.
1. Determine the bond requirment
If you are applying to become a licensed Farm Labor Contractor (FLC) under the H-2A visa program, the U.S. Department of Labor (DOL) requires you to secure a surety bond and the required bond amount is based off the number of workers you plan to employ. We confirm the correct bond amount for you.
2. Complete the H-2A / FLC Application
You must file the appropriate registration forms (Form ETA-790A and related FLC registration forms) with the Department of Labor. The bond is required as part of the contractor licensing process, not the visa petition
itself.
3. Underwriting and Approval
The surety companies base the approval / rate off a soft credit check of the owner
- 2% for 680+ credit
- 5% for 600-679 credit
- 10%+ for sub 600 credit
Financials statements may be required if the bond amount is over $200,000 or if the aggregate total for all bonds is over $750,000.
4. Pay Premium and Receive the Bond
Once you pay the premium:
- The surety issues the bond
- You submit the original bond to the Department of Labor as part of your FLC registration
